1. Agreement to Terms

By accessing and using Pickleball Wait Times ("the Service," "our Service," "we," "us," or "our"), you ("User," "you," or "your") accept and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and the operators of Pickleball Wait Times.

Important: If you do not agree to all the terms and conditions of this agreement, you are not authorized to access or use the Service. Your use of the Service constitutes acceptance of these Terms.

2. Description of Service

Pickleball Wait Times is a community-driven platform operated from Richmond, British Columbia, Canada, designed to serve the pickleball community by providing:

  • Real-Time Court Information: Current wait times and availability for pickleball courts
  • Community Updates: User-submitted reports on court conditions and wait times
  • Court Directory: Information about pickleball facilities in Richmond, BC and surrounding areas
  • Community Platform: A space for pickleball players to share information and connect

The Service relies on community participation and user-generated content to provide accurate, up-to-date information.

3. User Accounts and Registration

No Account Required: You can view court information and wait times without creating an account.

Submitting Updates: To submit wait time updates, you must provide:

  • Your name (displayed publicly with your update)
  • A valid email address (for verification and communication)
  • Accurate wait time information

Account Security: You are responsible for maintaining the confidentiality of any login information and for all activities that occur under your account.

4. User Conduct and Responsibilities

By using our Service, you agree to:

4.1 Provide Accurate Information

  • Submit truthful, accurate, and current wait time data
  • Report actual court conditions you have personally observed
  • Update information promptly if circumstances change
  • Not submit false or misleading information

4.2 Use Respectful Communication

  • Use appropriate, respectful language in all interactions
  • Avoid profanity, offensive content, or discriminatory language
  • Respect the rights and dignity of all users
  • Comply with the BC Human Rights Code in all communications

4.3 Respect Community Standards

  • Be considerate of other users and the broader pickleball community
  • Help maintain a positive, welcoming environment
  • Report inappropriate behavior or content
  • Follow established court etiquette and rules

4.4 Legal Compliance

  • Follow all applicable federal, provincial, and municipal laws
  • Respect intellectual property rights
  • Protect the privacy of other users
  • Comply with all relevant Canadian and BC regulations

5. Prohibited Uses and Activities

The following activities are strictly prohibited and may result in immediate termination of access:

5.1 False Information

  • Submitting false, misleading, or deliberately inaccurate wait time information
  • Creating fake reports or manipulating data
  • Impersonating other users or providing false identity information

5.2 Harmful Content

  • Using offensive, discriminatory, defamatory, or inappropriate language
  • Posting content that violates the BC Human Rights Code
  • Sharing content that promotes violence, hatred, or illegal activities
  • Harassment, bullying, or intimidation of other users

5.3 Technical Violations

  • Attempting to disrupt, damage, or interfere with the Service
  • Using automated systems to spam or overload the Service
  • Attempting to gain unauthorized access to user accounts or system data
  • Reverse engineering or attempting to extract source code

5.4 Commercial Misuse

  • Using the Service for unauthorized commercial purposes
  • Advertising or promoting unrelated products or services
  • Collecting user information for commercial use without consent

6. Content and Intellectual Property

6.1 User-Generated Content

When you submit wait time updates or other content to our Service:

  • Your name will be displayed publicly with your submission
  • You grant us a non-exclusive, royalty-free license to display and use this information
  • You retain ownership of your content but allow us to use it for Service operation
  • You represent that you have the right to submit the content

6.2 Service Content

All content, features, and functionality of the Service, including but not limited to:

  • Text, graphics, logos, images, and software
  • Design, layout, and user interface elements
  • Algorithms and data processing methods
  • Court information and database structure

Are owned by us or our licensors and are protected by Canadian copyright, trademark, and other intellectual property laws.

6.3 Content Moderation

We reserve the right to review, edit, or remove any user-generated content that violates these Terms, is deemed inappropriate, or may harm other users or the Service.

7. Privacy and Personal Information

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which complies with:

  • BC's Personal Information Protection Act (PIPA)
  • Canada's Personal Information Protection and Electronic Documents Act (PIPEDA)
  • Other applicable Canadian privacy legislation

By using the Service, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

8. Disclaimers and Limitations

8.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement or title
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy of user-generated content

8.2 Information Accuracy

We do not warrant the accuracy, completeness, or reliability of:

  • User-generated wait time information
  • Court details and facility information
  • Third-party content or links
  • Real-time data or updates

8.3 Service Availability

We do not guarantee that the Service will be available at all times. The Service may be subject to interruptions due to maintenance, technical issues, or circumstances beyond our control.

9. Limitation of Liability

To the maximum extent permitted by BC and Canadian law, we shall not be liable for any:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the Service
  • Damages resulting from reliance on user-generated content
  • Damages from unauthorized access to your information

Maximum Liability: Our total liability to you for all claims shall not exceed $100 CAD or the amount you paid to use the Service (if any), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pickleball Wait Times, its operators, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit to the Service

11. Termination

11.1 Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice, for:

  • Violation of these Terms
  • Conduct harmful to other users or the Service
  • Legal or regulatory requirements
  • Any other reason in our sole discretion

11.2 Effect of Termination

Upon termination, your right to use the Service will cease immediately. Previously submitted content may remain on the Service for community benefit, but you will lose the ability to submit new updates.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes may be made to reflect:

  • Changes in our business practices
  • New legal or regulatory requirements
  • Service improvements or new features
  • User feedback and community needs

Notice of Changes: Material changes will be posted on the Service with at least 30 days' notice where reasonably practicable. Your continued use after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with:

  • The laws of British Columbia, Canada
  • The federal laws of Canada applicable in British Columbia
  • Without regard to conflict of law principles

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

Before pursuing formal legal action, we encourage you to contact us directly to resolve disputes. Many issues can be resolved through direct communication.

15. Severability and Waiver

15.1 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision will be changed and interpreted to accomplish the objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.

15.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service and supersede all prior agreements and understandings.
